Terms ofService.
These terms are an agreement between you and Bean & Magoo ("we", "us"), the operator of Music Director HQ (the "Service"), available at musicdirectorhq.com and at each organisation's own address under that domain. By creating an organisation or signing in, you agree to them. If you are accepting on behalf of a band, church, company or other group, you confirm you have authority to bind it, and "you" means that organisation.
1. What the Service is
Music Director HQ is a hosted tool for music directors and the people they work with: setlists and running orders, audio references, band and crew rosters, personnel by date, day sheets and related planning. It is offered as a subscription per organisation. We may change, add or retire features; if a change materially reduces what your paid plan includes, we will tell you in advance and you may cancel for a pro-rated refund of any prepaid, unused period.
2. Your account and your people
- Access is by email sign-in link and code. You are responsible for the addresses you add to your organisation and for removing people who should no longer have access.
- You are responsible for everything done through your organisation's accounts. Tell us promptly at admin@musicdirectorhq.com if you believe an account has been misused.
- You must be at least 18, or the age of majority where you live, to create an organisation.
3. Trials, plans and payment
- New organisations start on a free trial of the length shown at signup. No card is required. When the trial ends, the organisation becomes read-only for a short grace period and then inaccessible until a plan is chosen. Nothing is deleted by the trial ending.
- Paid plans are billed per organisation, monthly, in advance, through our payment processor (Stripe). Prices, taxes and what each plan includes are shown at the time of purchase and in your organisation's Settings.
- You may change or cancel your plan at any time from Settings. Cancellation takes effect at the end of the current billing period; we do not refund partial months except as stated in section 1 or required by law.
- If a payment fails we will retry and notify the billing address. During a grace period the organisation is read-only and audio is paused; after it, access is suspended until payment succeeds. Data is retained as described in section 6.
- We may change prices with at least 30 days' notice; the new price applies from your next billing period after the notice.
4. Your content
- Everything you put into the Service — setlists, audio files, lyrics, rosters, notes, images — is yours. You grant us only the licence needed to store, process, transmit and display it to you and to the people you have given access, and to make backups.
- You are responsible for having the rights to what you upload. Audio references and lyrics belong to their rights-holders; the Service is a private working tool for a band or team, not a distribution platform, and you agree not to use it to publish or share material you do not have the right to share.
- We will not look at your content except to operate the Service, to respond to a support request you make, to investigate abuse or a security incident, or when the law requires it. Support access is logged with the reason.
5. Acceptable use
Do not use the Service to break the law, to infringe others' rights, to send unsolicited messages, to probe or disrupt the Service or other customers, or to attempt to access another organisation's data. We may suspend an organisation that does, after notice where practical.
6. Data retention and export
- While your organisation is active, on trial or in grace, we keep your data.
- If an organisation is suspended for non-payment or cancelled, we keep its data for at least 90 days so it can be reinstated. After that we may delete it.
- You can ask us at any time to export your organisation's data or to delete it, and we will do so within 30 days, subject to backups that expire on their own schedule.
7. Availability and support
We aim to keep the Service available at all times but do not guarantee it. Bands work at night and on weekends and we know it; still, this is a small operation and there may be maintenance or outages. Support is by email at admin@musicdirectorhq.com.
8. Disclaimer and limitation of liability
The Service is provided "as is". To the fullest extent the law allows, we disclaim all warranties, and our total liability to you for any claim arising from the Service is limited to the amount you paid us in the twelve months before the claim. We are not liable for indirect, incidental or consequential loss — including a missed cue, a wrong key or a show that goes badly. Keep a printed setlist; we do.
9. Termination
You may close your organisation at any time. We may suspend or terminate an organisation for breach of these terms or non-payment, as described above. Sections 4, 6, 8 and 10 survive termination.
10. General
- These terms are governed by the laws of the State of Tennessee, USA, without regard to conflict-of-law rules, and disputes will be brought in the state or federal courts located there.
- If any part of these terms is unenforceable, the rest still applies.
- We may update these terms. We will post the new version here with a new date and, for material changes, notify the admins of each organisation by email. Continued use after the effective date is acceptance.
